As a highly experienced litigator on both sides of the litigation fence I know just how valuable certainty of outcome for parties in dispute is; a negotiated resolution of conflict in a secure confidential environment avoids the high cost in real dollars, time and angst that is all too often the unsatisfactory, uncertain and costly litigation process.
Mediation
Parties to a dispute often find themselves locked into what from their perspective is an opaque often frustratingly slow litigation process where they are not heard and worse still legal practise and procedure seems to override all.
It is my role to help the parties cut through all this in an empathetic way but with respect to their right to put their side, to be heard and seek a way forward without pressure.
Ultimately getting on with things rather than being mired in a costly dispute is the goal, acknowledging there are two sides to everything and a legal decision can be a very costly way of finding out that no matter its apparent strengths ”your side” is never a certainty.
